11.    For an entry using the Entry Form, time of entry is determined by the time the online entry is received by the Promoter’s database, and not the time of submission by the Entrant.
12.    For the avoidance of doubt, the maximum number of entries every 24 hours to be considered as an eligible return for this Promotion is either:
(a)    One Double Entry for an Entrant using their member number; or

PROMOTER’S DECISIONS ARE FINAL
39.    Subject to the Dispute Resolution section below, the Promoter’s decisions relating to this promotion are final. The Promoter will not enter into general correspondence regarding the promotion results or other decisions made in connection with this promotion. Formal disputes must be submitted in accordance with the Dispute Resolution section below.

DISPUTE RESOLUTION
40.    In the event of a dispute between an Entrant and the Promoter in connection with this promotion, the Entrant must submit a written complaint to the Promoter at [email protected]. The Promoter will acknowledge the complaint within five (5) business days and will use reasonable endeavours to resolve the dispute within twenty (20) business days of receipt. If the dispute is not resolved within that period, either party may refer the matter to a mediator agreed upon by both parties, or failing agreement, to a mediator appointed by the Resolution Institute (www.resolution.institute). The costs of mediation will be borne equally by the parties unless otherwise agreed. Nothing in this clause prevents a party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.

PUBLICITY MATERIALS
41.    Entrants consent to the Promoter using their name, likeness, image, Collection Volume and/or voice in the event they are a winner (including photography, film and/or recording of the same) in any media for an unlimited period and without remuneration for the purposes of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Where the Entrant is a Minor, the parent/guardian of that Entrant gives such consent on behalf of the Entrant. Where the winner is a community group, school or charity, an authorised representative of that organisation gives such consent on behalf of the organisation, and the Promoter may use the organisation's name and any information provided by the organisation in connection with publicity for this promotion.

GENERAL
42.    Where an Entrant or other depositor attempts to return and deposit (or donate) containers which are not eligible under the Containers for Change scheme, those containers will be refused and will not count towards the Entrant’s collections in this promotion.
43.    Containers are processed by third parties and as such, the Promoter is not responsible for and has no control over the timing or method of the processing and reporting of the containers presented. The Promoter is not liable for any loss or damage arising from any containers being processed by a third party outside of the Promotional Period (or any delays in processing within that period), or any errors in reporting by a third party.
44.    If a Prize (or part of a Prize) is unavailable, the Promoter, at its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize similar to and of equal or greater value than the original Prize.
45.    Prizes or any unused portion of a Prize are not transferable or exchangeable and cannot be taken as cash.
46.    Acceptance of a Prize may require the winner to also accept and comply with third party terms. To the extent that any Prize (or part of a Prize) consists of a gift card or voucher, it will be subject to the terms and conditions stipulated by the relevant Prize supplier. Digital gift cards must be activated by the date stipulated by the Prize supplier, and the Promoter is not responsible for any failure to do so.  Some Prizes may only be valid for use on a specified date and/or at a specified time, as determined by the relevant prize supplier, event or experience provider. It is the responsibility of the winner to attend or use the Prize at or by the specified date and time. No extensions, substitutions or compensation will be provided if the winner is unable to use the Prize as specified.
47.    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right to the fullest extent permitted by law:
(a)    to disqualify any Entrant; or
(b)    to modify, suspend, terminate or cancel the promotion, as appropriate and is not liable to any Entrant for any loss arising from the exercise of its discretion.
48.    If there is a dispute as to an Entrant’s identity, eligibility to enter or validity of entry, or interpretation of these Terms and Conditions, the Promoter reserves the right to determine these matters. The Promoter reserves the right, at any time, to verify the validity of entries and the eligibility of Entrants.
49.    The Promoter further reserves the right, in its sole discretion, to disqualify any individual who the Promoter reasonably believes has or may have breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
50.    The Promoter reserves the right to amend these Terms and Conditions at any time (without prior notice) without liability to any Entrant or other person, subject to applicable laws. These Terms and Conditions and any revised Terms and Conditions will be available at: https://www.containersforchange.com.au/qld/big-bincoin-bonus-terms-and-conditions-2026
51.    This promotion is governed by the laws of Queensland. Each party submits to the non-exclusive jurisdiction of the courts of Queensland and any courts of appeal therefrom.
52.    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. This includes (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or Entrant; (e) taking and/or use of a prize; (f) the download and/or use of any app or file on the device used by the Entrant, or the Entrant's parent/guardian in connection with this promotion (including viruses and malware); (g) any late, lost, damaged or misdirected Prize due to any reason beyond the reasonable control of the Promoter, including any error or change in the Winner's nominated addresses; and (h) participation in this promotion (including the contraction of any illness, virus or disease howsoever described whilst participating in this promotion).

PRIVACY AND COLLECTION NOTICE
53.    The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, available at: https://www.containersforchange.com.au/privacy-policy (“Privacy Policy”).
54.    In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant.
