COMPETITION TERMS AND CONDITIONS

'WIN THE ULTIMATE COIN TOSS EXPERIENCE' 

PROMOTION TERMS AND CONDITIONS (Game of Chance) 

7. Information on how to enter and prizes form part of these Terms and Conditions. If there is any inconsistency between these Terms and Conditions and anything else that refers to this promotion, these Terms and Conditions prevail.
8. The Promoter is Container Exchange (Qld) Limited ACN 622 570 209 ("Promoter") of Level 17, 100 Creek Street, Brisbane, QLD 4000. Telephone number 13 42 42.
9. Participation in this promotion is deemed acceptance of these Terms and Conditions by the entrant. 

10. This promotion is a game of chance. 

     

ELIGIBILITY

5. Entry is only open to individuals who are Queensland residents aged 18 years of age or older.
6. Directors, management, employees and their immediate families, of the Promoter, retailers, suppliers, associated entities and agencies associated with this competition are ineligible to enter.

PROMOTIONAL PERIOD

7. The promotion commences at 1:30pm AEST on Tuesday 10 June 2025, and ends at 9:00am AEST on Wednesday 11 June 2025 (“Promotional Period”).

HOW TO ENTER

8. To enter, the entrant must, during the Promotional Period: 
   (a)    go to the Promoter’s Instagram page, locate the Promotion post designated by the Promoter (“Promotion Post”); and then, 
   (b)    via their personal Instagram account, follow the Instagram page and in a comment section to the Promotion Post, tag the personal accounts of one friend and tell us your best 10-cent container return or collection tip.
9. Entries must be received by the Promoter before the end of the Promotional Period. Time of entry is determined by the time stamp on the Promoter's Instagram page.
10. Only one (1) entry per Eligible Participant is permitted.
11. Late, incomplete, indecipherable or profane entries, as determined by the Promoter, will be deemed invalid.
12. The entrant warrants that they:
    (a)    will not upload or submit content that is unlawful (or may be unlawful), profane, defamatory, discriminatory or any other content that is in the opinion of the Promoter offensive, inappropriate or would cause harm to its business interests or reputation or portray the Promoter or the Container for Change beverage container refund scheme in a negative light; and
    (b)    owns all rights and intellectual property rights in is entry, and grants the Promoter exclusive, perpetual, royalty-free, irrevocable, licence to use, reproduce, modify, adapt, develop, support and maintain that the Promotion entry in connection with this promotion.
13. The Promoter reserves the right to reject, approve or remove any entries for any reason.
14. The Promoter reserves the right, at any time, to verify the validity of entries and the eligibility of entrants (including an entrant’s identity, age and place of residence). The Promoter further reserves the right, in its sole discretion, to disqualify any individual who the Promoter reasonably believes has or may have breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.  Errors and omissions may be accepted at the Promoter's discretion.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.  The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
15. If there is a dispute as to an entrant’s identity, eligibility to enter or validity of entry, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant, eligibility to enter and validity of any entry.
16. Entry into this promotion is free. However, any cost associated with participating in this promotion is the Eligible Participant’s responsibility.

HOW TO WIN

17. To be eligible to win the Prize, entrants must:
    (a)    return a minimum of 50 eligible drink containers to a Containers for Change Queensland refund point (Depot) using their Containers for Change Member Number between 1 June 2025 and 9.00am AEST on Wednesday 11 June 2025;
    (b)    follow the Promoters Instagram @4changeqld via the entrant’s personal Instagram account; and
    (c)    on the Promotion Post, tag the personal Instagram account of one friend and comment on the entrant’s best 10-cent container return or collection tip.  
18. Only eligible containers processed at a Depot during the Promotional Period will be counted. Time of processing is as recorded on the Promoter’s database.

PRIZE

19. There will be one (1) Prize (“Prize”) to be won comprised of 2 x Adult reserved general admission tickets to the Brisbane Lions vs. GWS GIANTS match on 14 June 2025 at The Gabba. All tickets are valid until the expiry date as specified on the ticket or by the prize supplier. Tickets are subject to the conditions stipulated by the prize supplier.
20. Total prize pool retail value is up to $100 inclusive of GST) as at 9 June 2025. The Promoter is not responsible for any changes in the value of the Prize.
21. As a bonus, the Promoter offers the winner the opportunity to participate in the pre-match Coin Toss (“Coin Toss Experience”). This is a ‘money can’t buy’ experience and is not included in the prize pool. The Coin Toss Experience is only open to those aged 18 years old or above.

PRIZE NOTIFICATION

22. The winning Eligible Participant will be announced within 2 hours of the end of the Promotional Period. The winner will be notified by Instagram direct message used on the Promotion Post (“Prize Notification”).
23. The winner’s name may be published on the Promoter’s social media accounts for the purposes of this promotion.  The winner’s name may also be printed in an eDM published and distributed by the Promoter.
24. Any winner of the Prize is provisional until such time as the Promoter is satisfied that the entrant has complied with these Terms and Conditions (including any conditions of accepting a Prize).

CLAIMING THE PRIZE

25. The Prize must be claimed within 1 hour of the Promoter notifying the entrant of their win, or such longer time stipulated by the Promoter ("Claim Deadline").
26. To claim the Prize, the winner must (unless otherwise agreed in writing by the Promoter):
    (a)    follow the instructions in the Prize Notification to accept and provide a valid email address, mobile phone number and Containers for Change member number ("Nominated Address").
27. If for any reason the winner does not claim the Prize by the Claim Deadline, then the Prize will be forfeited, and a new winner will be selected from the remaining pool of Eligible Participants. 

PRIZE DELIVERY

28. The Prize is deemed to be delivered to a winner at the time the Promoter or Promoter’s prize supplier posts the Prize to the winner's Nominated Address. In the case of the digital tickets, it is deemed to be delivered when the Promoter or the Prize supplier emails a link to activate the tickets to the winner’s nominated email address.
29. Winners of any redraw will be notified within 24 hours of the date of the relevant redraw via their nominated email address. The re-draw winner will be required to confirm their email address to receive the prize. Clauses 21 to 29 also apply to the winner determined by redraw.

PROMOTER'S DECISIONS ARE FINAL

30. The Promoter’s decisions relating to this promotion are final. The Promoter will not enter into correspondence regarding the promotion results or any other decisions the Promoter makes in connection with this promotion.
    Publicity materials
31. If you are a winner, the Eligible Recipient must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. The Eligible Recipient (and/or their parent/guardian) also agrees to the release of their mobile number and date of birth to third parties.
32. Entrants consent to the Promoter using the Eligible Participant’s name, logo and total container volume information for the promotion in any media (including the Promoter’s social media accounts, eDMs, Containers for Change website) for an unlimited period and without compensation for the purpose of promoting this promotion (including the promotion of any outcome and progress updates).
33. By entering this Competition, Eligible Recipients consent to the use of their personal information and that the Promoter may contact them for future marketing and material purposes without payment. Eligible Entrants agree that the Promoter may use this information for that purpose.

GENERAL

34. Where an entrant or other depositor attempts to return and deposit (or donate) containers which are not eligible under the Containers for Change scheme, those containers will be refused and those containers will not count towards the Eligible Recipient’s collections in this promotion.
35. Containers are processed by third parties and as such, the Promoter is not responsible for and has no control over the timing or method of the processing of any containers presented, and how it is reported by the third party. The Promoter is not liable for any loss or damage arising from any containers being processed by a third party outside of the Promotional Period (or any delays in processing within that period), or errors in any reporting by the third party.  
36. Time of entry is determined by the time the online entry is received by the Promoter's database, and not the time of submission by the entrant.  
37. Incomplete, indecipherable or profane entries, as determined by the Promoter, will be deemed invalid.  However, errors and omissions may be accepted at the Promoter's discretion.
38. If a Prize (or part of a Prize) is unavailable, the Promoter may substitute the Prize (or that part of the Prize) with a Prize similar to and of equal or greater value than the original Prize.
39. Prizes or any unused portion of a Prize are not transferable or exchangeable and cannot be taken as cash.
40. Prizes that are gift cards are subject to the conditions stipulated by the Prize supplier.  Digital gift cards must be activated by the date stipulated by the Prize supplier, and the Promoter is not responsible for any failure to do so.
41. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right to the fullest extent permitted by law:
    (a)    to disqualify any entrant; or
    (b)    to modify, suspend, terminate or cancel the promotion, as appropriate and is not liable to any entrant for any loss arising from the exercise of its discretion.
42. If there is a dispute as to an entrant’s identity, eligibility to enter or validity of entry, or interpretation of these Terms and Conditions, the Promoter reserves the right to determine these matters. The Promoter reserves the right to verify the validity of entries and the eligibility of entrants.
43. The Promoter further reserves the right to disqualify any individual who the Promoter reasonably believes has or may have breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.
44. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

46. This Promotion is governed by the laws in Queensland.
47. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. This includes (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; (e) taking and/or use of a prize; (f) the download and/or use of any app or file on the device used by the entrant, or the entrant's parent/guardian in connection with this promotion (including viruses and malware); (g) any late, lost, damaged or misdirected Prize due to any reason beyond the reasonable control of the Promoter, including any error or change in the Winner's nominated addresses; (g) participation in this promotion (including the contraction of any illness, virus or disease howsoever described whilst participating in this promotion); and (h) any act or omission by Brisbane Bears-Fitzroy Football Club in connection with this promotion (including information you provide to them via the Entry Form).

PRIVACY COLLECTION AND NOTICE

48. The Promoter does not intend to collect personal information ("PI") over and above that specifically mentioned herein and the information collected in connection with Member Numbers. In this regard, the Promoter suggests that the entrant review the Promoter’s Privacy Policy. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.containersforchange.com.au/privacy-policy.   
49. You agree that the Promoter may use and handle such PI as set out in its Privacy Policy.
