Container Collect Booking Platform Terms of Use

Welcome to the Container Collect Booking Platform!

The Container Collect Booking Platform (Platform) provides a simple, self-service way for you to arrange Collection Services and receive your statutory refund through Queensland’s Beverage Container Refund Scheme (Scheme) – known as Containers for Change.

1. About these Terms of Use

These Container Collect Booking Platform Terms of Use (Terms of Use) govern your access to and use of the Platform, including any website, mobile application interface and related systems through which Collection Services are made available to you.

The Platform is operated by us, Container Exchange (Qld) Limited (ACN 622 570 209) (COEX, Us, Our).

These Terms of Use form part of, and are incorporated into, the Customer Terms & Conditions; they are not a separate contract. By accessing or using the Platform, you agree to comply with them. If you do not agree, you must not use the Platform.

The Customer Terms & Conditions govern the Collection Services, including Collection Bookings, Collection Fees, Refund Amounts and your obligations in relation to containers and Collection Services. A Booking Agreement governs your Collection Booking with a container refund point operator (referred to as Operators).

If there is any inconsistency between these Terms of Use and the Customer Terms & Conditions, the Customer Terms & Conditions prevail.

Our Privacy Policy explains how we treat your personal data and protect your privacy when you use the Platform.

2. The Platform services

We provide the Platform as a technology service that enables you, as a user, to:

  • view, compare and request Collection Services from container refund point operators, including their availability and Collection Fees;
  • manage Collection Bookings; and
  • create and maintain user profiles, including nominated collection addresses.

3. Eligibility and profile

To use the Platform, you must:

  • be at least 18 years old;
  • create and maintain a Container Collect profile in your own name; and
  • provide accurate, current and complete profile information.

You must not:

  • allow another person to use your profile in a way that misrepresents your identity;
  • assign, transfer or otherwise deal with your profile; or
  • create a profile using false or misleading information.

You are responsible for all activity that occurs under your profile, but excluding anything to the extent we have caused it.

You must notify us immediately if you become aware of any unauthorised access to your profile or any security breach.

We may suspend or restrict your profile if we reasonably suspect unauthorised use, fraud or a security issue.

4. Identity verification

We may require you to verify your identity or provide additional information to access or continue using the Platform or for an Operator to complete a Collection Booking (for example, in connection with Bulk Claims of over 1500+ containers).

If you do not provide the information requested, we may:

  • cancel a Collection Booking;
  • delay or prevent an Operator from assessing, accepting or processing containers if the information is needed to complete the booking, comply with Scheme requirements or comply with law;
  • delay paying or crediting a Refund Amount if the information is needed to verify your entitlement, comply with Scheme requirements or comply with law; and/or
  • suspend or restrict your access to the Platform

5. User requirements and conduct

You must comply with all applicable laws when accessing or using the Platform.

You must not use the Platform:

  • for any unlawful purpose, including providing ineligible or non-compliant containers for collection or processing under the Scheme (being Queensland’s beverage container refund scheme described in the Waste Reduction and Recycling Act 2011 (Qld));
  • to engage in fraudulent, misleading or deceptive conduct;
  • in a way that causes nuisance, inconvenience, damage or safety risk to:
    • an Operator;
    • COEX; or
    • any other person or property.

When interacting with Operators (including through the Platform or at your property), you must behave in a safe, respectful and reasonable manner.

You must not engage in abusive, threatening or inappropriate behaviour toward any Operator or representative of COEX.

You are responsible for all electronic communications and content sent from your profile or device to us or to Operators through the Platform. Where the Platform allows you to send material to an email address, you confirm that you have entered the correct address and, where the recipient is another person, that you have that person's consent to receive it.

6. Restrictions on use

You must not, and must not allow any other person to:

  • remove or alter any copyright, trade-mark or proprietary notices;
  • copy, reproduce, distribute, sell or commercially exploit any part of the Platform;
  • modify, adapt or create derivative works from the Platform;
  • reverse engineer, decompile or disassemble any part of the Platform (except as permitted by law);
  • link to, frame or mirror any part of the Platform without written consent;
  • use automated tools (including bots, scripts or scraping technologies), or any manual means, to access, extract, copy, harvest or download data from the Platform except as expressly permitted;
  • aggregate, compile, store in a database, disclose, republish or transfer to any third party any data obtained through the Platform, or use any such data for any purpose other than arranging your own collections;
  • interfere with or disrupt the operation or functionality of the Platform; or
  • attempt to gain unauthorised access to the Platform or related systems.

7. Licence and Intellectual Property

Your right to access and use the Platform is granted under, and on the terms set out in, the Customer Terms & Conditions. Intellectual property rights in the Platform and the Collection Services, and the assignment of any feedback you provide, are also dealt with in the Customer Terms & Conditions.

8. Data and privacy

Your personal information is handled in accordance with our Privacy Policy.

By using the Platform, you acknowledge that:

  • your information may be shared with Operators to fulfil bookings and give effect to payment directions; and
  • you must not access, use or disclose personal information of others except as permitted by law and these Terms of Use.

9. Platform functionality and availability

Except for any rights and obligations that cannot be excluded by law, the Platform is provided on an “as is” and “as available” basis.

Collection Services are offered as a convenient optional service for customers in addition to drop off at container refund points.

While we take reasonable steps to make the Platform available, except for any rights and obligations that cannot be excluded by law we do not guarantee that:

  • the Platform will be available at all times;
  • access will be uninterrupted or error-free; or
  • the Platform will be free from typographical errors, inaccuracies or omissions (including in relation to pricing, fees, availability or content), which we may correct where reasonable to do so; or the Platform or the servers that make it available are free of viruses or other harmful components.

We may:

  • update, modify or improve the Platform;
  • change or remove features; or
  • suspend or restrict your access

where reasonably necessary for operational, technical, security or legal reasons. This and other circumstances beyond our control, may result in the Platform being unavailable from time to time.  Where we are reasonably able, we will notify you (through the Platform) in advance of doing any of the above things.

10. Third-party tools and links

The Platform may give you access to third-party tools (such as mapping services) or links to third-party websites that we do not control, monitor or endorse. Any such tools and content are provided on an "as is" and "as available" basis, and you use them at your own risk. We are not responsible or liable for any third-party tools, content, websites, or any associated loss or damage, and the inclusion of any link does not imply endorsement by us.

11. Suspension and termination

We may suspend, restrict or terminate your access to the Platform if:

  • you breach these Terms of Use and/or the Customer Terms and Conditions;
  • your conduct impacts the safety, integrity or reputation of the Platform or the Scheme; or
  • we are required to do so by law.

Where reasonably practicable, we will notify you of the reason. In the case of any suspension or restriction of access, we will also notify you of what is required to restore access.  Any suspension or restriction will continue only for as long as reasonably necessary and does not relieve you of your obligations under these Terms of Use that are capable of being performed notwithstanding the suspension or restriction.

You may stop using the Platform at any time.

12. General

Changes to the Platform: We may add, change or remove features or functionality to the Platform; modify or introduce limitations or other features to ensure the Platform remains aligned with operational requirements for the Collection Services. We may discontinue the Platform altogether at any time by giving at least 30 days’ written notice to you, or sooner if we cease to offer, or materially vary, the Container Collect network.  Where reasonably possible, we will provide you with prior notice of this through the Platform.

Changes to these Terms of Use: We may modify these Terms of Use (and any policies or other documents referenced in these Terms of Use) from time to time. We will post the most current version of these Terms of Use on our website. We will provide you with reasonable advance notice of any change to the Terms of Use that, in our reasonable determination, materially adversely affect your rights or your use of the Platform or the Collection Services. If you do not agree to the change, you should cease using the Platform before the changes take effect. Your continued use of the Platform after changes take effect constitutes acceptance.

Definitions and interpretation: Capitalised terms used but not otherwise defined in these Terms of Use have the meaning given to them in the Customer Terms & Conditions. If there is any inconsistency between a definition in these Terms of Use and the Customer Terms & Conditions, the Customer Terms & Conditions prevail.
