Terms and Conditions

1    Introduction

1.1    These terms and conditions (Terms) apply to the Container Saver of the Day Instagram Competition (Competition).

1.2    By submitting an entry into the Competition, entrants represent and warrant that they have read, understood and agree to be bound by these Terms.

2    The promoter of the Competition is WA Return Recycle Renew Ltd (ACN 629 983 615) (Promoter) of Unit 2, 1 Centro Avenue, Subiaco, Western Australia.

2.1    These Terms will be published on the Promoter's website: https://warrrl.com.au.

3.    Duration 

3.1    The Competition will commence at 9.00am (AWST) on Saturday, 25 September 2021 and all entries must be received before 11.59pm (AWST) on Saturday, 2 October 2021 (Competition Period). 

4.    Eligibility 

4.1    Entry to the Competition is only open to individuals who are, at the time of entry: 
(a)    a permanent resident of Western Australia; and
(b)    at least 18 years of age. 

4.2    The following persons are ineligible to participate in the Competition and may not redeem any prizes offered in the Competition: 
(a)    employees and the immediate families of the Promoter, its related bodies corporate, Competition sponsors and the suppliers of Competition prizes;
(b)    a person whose entry, in the opinion of the Promoter, includes any content which may be or is unlawful, profane, inflammatory, defamatory and/or damaging to the goodwill or reputation of the Promoter; and 
(c)    a person who breaches any of these Terms. 

4.3    The Promoter reserves the right to verify the validity of entries and to disqualify the entry of any person who, in the opinion of the Promoter, is ineligible to participate in the Competition under clause 4.2 above.

4.4    The Promoter reserves to the right to disqualify any entrant who, in the opinion of the Promoter, tampers with the entry process, submits an entry that is not in accordance with these Terms, or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the Competition or the Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner or the winner’s entry is of a type described in this clause.

5.    Method of Entry

5.1    To enter the Competition, a person must: 
(a)    take a photo with either of the Promoter's photo opportunity walls at the Perth Royal Show (CFC Photo) from 25 September 2021 to 2 October 2021 (Competition Period); and
(b)    post a CFC Photo on their personal Instagram and tag @4changewa with the hashtag #DontFeedTheFill (Entry Post).

5.2    Entry Posts made on Instagram after the end of the Competition Period will be deemed invalid and will not be eligible for any prize. 

5.3    The Competition is in no way conducted, sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Twitter or other third-party social media platform.  

6.    Number of Entries

6.1    Each entrant is only entitled to one entry in the Competition.

6.2    There is no entry fee and no purchase necessary to enter the Competition.

7.    Prize Details and Selection of Winners  

7.1    There are 8 x $600 Mastercard gift card prizes.  

7.2    A winner of each $600 Mastercard gift card will be selected by chance by the Promoter each day during the Competition Period via use of a random number generator selected via an excel spreadsheet. 

7.3    Winners will be notified by the Promoter via private message from the "@4changewa" Instagram account. 

7.4    Winners have 48 hours from the announcement under clause 7.7 to respond to the @4changewa Instagram account and claim their prize. To claim a prize, participants must provide their full name, email, and phone number to the Promoter. 

7.5    The Promoter reserves the right to require winners to provide, to the satisfaction of the Promoter in the Promoter's absolute discretion, proof of age, identity, residency and/or other proof of entry validity. In the event that a winner cannot provide such proof, the winner will forfeit the prize in whole and no substitute will be offered.

7.6    If the winner selected does not respond to the Promoter within the 48-hour time frame in clause 7.4, the Promoter has the right to draw another winner via use of the third party # picker platform arbitery.com.  

7.7    Once the winner has been confirmed they will be announced on Instagram by the Promoter the following day at 10am. 

7.8    Each winner will be contacted by or on behalf of the Promoter to arrange for the winner to collect their prize. 

7.9    Winners can collect their prize from the Royal Show offices at Claremont Showgrounds, 1 Graylands Road, Claremont, WA, 6010 on and from 4 October 2021 for a period of 30 days. If: 
(a)    the Promoter cannot contact a winner; or
(b)    a prize has not been claimed by the winner,
within that 30 day period, the relevant prize will be forfeited to the Promoter and that winner will have no claim or recourse against the Promoter in relation to the forfeited prize.

7.10    Upon entering the Competition, each entrant warrants that that entrant's CFC Photo is an original piece of work and does not contravene any applicable legislation or legislative instrument, nor is it illegal, defamatory, seditious, blasphemous or an infringement of copyright, trademark or industrial design. 

7.11    The Promoter's decision on all winners is final and the Promoter will not enter into correspondence regarding the Competition result. 

7.12    The entitlement to a prize is not transferable.

7.13    The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with the Competition.

8.    Copyright and Publicity

8.1    All entrants in the Competition agree that if they are selected as a winner of the Competition, the Promoter may use and publicise their names, likenesses, images and/or voices and their winning prize in any media for an unlimited period without remuneration for the purpose of promoting the Competition (including any outcome), and promoting the Western Australian container deposit scheme.

9.    Liability

9.1    To the extent permitted by law, all entrants release the Promoter from, and indemnify the Promoter against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the Competition including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property, whether direct or consequential, foreseeable, or due to some negligent act or omission or otherwise.

10.    Privacy 

10.1    By providing the Promoter with personal information, each entrant agrees with the terms of the Promoter's privacy policy which can be found at: https://warrrl.com.au/privacy-policy.

10.2    Each entrant consents to the Promoter using the entrant's personal information for the purposes of contacting the entrant to advise about the entrant's success or lack of success in participating in the Competition.

10.3    Each entrant consents to the Promoter, after the completion of the Competition using the entrant's personal information for the purposes of periodically contacting the entrant in relation to the Western Australian container deposit scheme.

10.4    Upon contact, each entrant will have the option to opt out of future communications from the Promoter.

11.    Failure to Enforce Terms

11.1    A failure by the Promoter to enforce any one of these Terms in any instance will not give rise to any claim or right of action by any other person or entrant.  The Promoter will not enter into correspondence in relation to such matters.

12.    Amendment of Terms and Termination of Competition

12.1    Subject to first obtaining the written approval of the Commission under the Gaming and Wagering Commission Act 1987 (WA), the Promoter may at any time and in its absolute discretion:
(a)    amend these Terms; and/or
(b)    terminate this Competition. 

12.2    If the Competition is terminated before the end of the Competition Period, the Promoter will not award any prize that, at the date of termination, has yet to be drawn.

13.    Further Terms and Conditions

13.1    These Terms are governed by the laws in force in Western Australia.
