1. Introduction

1.1 These terms and conditions (Terms) apply to the Empties Day Survey Giveaway (Competition).

1.2 By submitting an entry into the Competition, entrants represent and warrant that they have read, understood and agree to be bound by these Terms.

1.3 The promoter of the Competition is WA Return Recycle Renew Ltd (ACN 629 983 615) (Promoter) of Unit 2, 1 Centro Avenue, Subiaco, Western Australia.

1.4 These Terms will be published on the Promoter's website: containersforchange.com.au/wa

2. Duration

2.1 The Competition will commence at 2.00pm (AWST) on Thursday 17 March 2022 and all entries must be received before 5.00pm (AWST) on Sunday, 27 March 2022 (Competition Period).

3. Eligibility

3.1 Entry to the Competition is only open to individuals who are, at the time of entry:

(a) a permanent resident of Western Australia; and

(b) at least 18 years of age.

3.2 Each of the following persons are ineligible to participate in the Competition and may not redeem any prizes offered in the Competition:

(a) employees and the immediate families of the Promoter, its related bodies corporate, Competition sponsors and the suppliers of Competition prizes;

(b) a person who uses or attempts to use more than one name in entering the Competition;

(c) a person whose entry is incomplete or incomprehensible or whose entry, in the opinion of the Promoter, includes any content which may be or is unlawful, profane, inflammatory, defamatory and/or damaging to the goodwill or reputation of the Promoter; and

(d) a person who breaches any of these Terms.

3.3 The Promoter reserves the right to verify the validity of entries and to disqualify the entry of any person who, in the opinion of the Promoter, is ineligible to participate in the Competition under clause 3.2 above.

3.4 The Promoter reserves to the right to disqualify any entrant who, in the opinion of the Promoter, tampers with the entry process, submits an entry that is not in accordance with these Terms, or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the Competition or the Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner or the winner’s entry is of a type described in this clause.

4. Method of Entry

4.1 To enter the Competition, a person must complete the 'Empties Day — Tell us about your experience!' survey at https://www.surveymonkey.com/r/LMKY367 (Entry) from 17 March 2022 to 27 March 2022 (Competition Period), including the provision of the following information:

(a) first and last name; and

(b) email address.

4.2 Entries received after the end of the Competition Period will be deemed invalid and will not be eligible for any prize.

4.3 If an entrant’s contact details change during the Competition Period, it is the entrant’s responsibility to notify the Promoter of that change.

4.4 The entrant is responsible for the accuracy of their entry details.

4.5 The Promoter has no responsibility or liability for lost or misdirected entries.

4.6 The Competition is in no way conducted, sponsored, endorsed or administered by, or associated with Mailchimp, arbitery.com or any other third party marketing, survey or social media platform.

5. Number of Entries

5.1 Each entrant is only entitled to one entry in the Competition.

5.2 There is no entry fee and no purchase necessary to enter the Competition.

6. Prize Details and Selection of Winners

6.1 The winner of the Competition will receive 1 x Containers for Change 240L wheelie bin.

6.2 The winner will be selected by chance by the Promoter on 29 March 2022 via use of the third party random selection platform arbitery.com.

6.3 Subject to the winner having provided the Promoter with accurate contact details, the prize winner will be notified by the Promoter via email within 24 hours of their selection as a winner.

6.4 The winner has 48 hours from being notified clause 6.3 to respond to the email and claim the prize. To claim the prize, the winner must provide their full name, email, phone number and, if they live outside the Perth metropolitan area, their shipping address (which must be within Western Australia), to the Promoter.

6.5 The Promoter reserves the right to require winners to provide, to the satisfaction of the Promoter in the Promoter's absolute discretion, proof of age, identity, residency and/or other proof of entry validity. In the event that a winner cannot provide such proof, the winner will forfeit the prize in whole and no substitute will be offered.

6.6 If the Promoter cannot contact a winner under clause 6.3 or the winner does not respond to the Promoter within the 48-hour time frame in clause 6.4, the Promoter has the right to draw another winner via use of the third party random selection platform arbitery.com.

6.7 If the winner selected lives outside of the Perth metropolitan area, the Promoter will arrange delivery of the prize to the winner at the address advised by the winner under clause 6.4 within 30 days of the winner supplying their shipping address under clause 6.4.

6.8 A winner living in the Perth Metro area must collect their prize from the Promoter's office at Unit 2 Ground Floor, 1 Centro Ave, Subiaco from 29 March 2022 within 30 days of being notified under clause 6.3.

6.9 If:

(a) a prize has not been claimed by the winner living in the Perth Metro area within the 30 day period referred to in clause 6.8; or

(b) the winner lives outside of the Perth metropolitan area and has not advised the Promoter of their address for delivery under clause 6.4, the prize will be forfeited to the Promoter and that winner will have no claim or recourse against the Promoter in relation to the prize.

6.10 A winner living outside the Perth metropolitan area will have their prize dispatched within 30 days of the winner supplying their shipping address under clause 6.4.

6.11 The Promoter's decision on all winners is final and the Promoter will not enter into correspondence regarding the Competition result.

6.12 The entitlement to a prize is not transferable.

7. Copyright and Publicity

7.1 All entrants in the Competition agree that if they are selected as a winner of the Competition, the Promoter may use and publicise their names, likenesses, images and/or voices and their winning prize in any media for an unlimited period without remuneration for the purpose of promoting the Competition (including any outcome), and promoting the Western Australian container deposit scheme.

8. Liability

8.1 To the extent permitted by law, all entrants release the Promoter from, and indemnify the Promoter against, all liability, cost, loss or expense arising out of acceptance of any prize or participation in the Competition including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property, whether direct or consequential, foreseeable, or due to some negligent act or omission or otherwise.

9. Privacy

9.1 By providing the Promoter with personal information, each entrant agrees with the terms of the Promoter's privacy policy which can be found at: https://warrrl.com.au/privacy-policy.

9.2 Each entrant consents to the Promoter using the entrant's personal information for the purposes of contacting the entrant to advise about the entrant's success or lack of success in participating in the Competition.

9.3 Each entrant consents to the Promoter, after the completion of the Competition using the entrant's personal information for the purposes of periodically contacting the entrant in relation to the Western Australian container deposit scheme.

9.4 Upon contact, each entrant will have the option to opt out of future communications from the Promoter.

10. Failure to Enforce Terms

10.1 A failure by the Promoter to enforce any one of these Terms in any instance will not give rise to any claim or right of action by any other person or entrant. The Promoter will not enter into correspondence in relation to such matters.

11. Amendment of Terms and Termination of Competition

11.1 Subject to first obtaining the written approval of the Commission under the Gaming and Wagering Commission Act 1987 (WA), the Promoter may at any time and in its absolute discretion: (a) amend these Terms; and/or (b) terminate the Competition.

11.2 If the Competition is terminated before the end of the Competition Period, the Promoter will not award any prize that, at the date of termination, has yet to be drawn.

12. Further Terms and Conditions

12.1 These Terms are governed by the laws in force in Western Australia.
